Privacy Policy

Pursuant to Art. 13 section 1-2 GDPR - we inform you that:

 

I. The controller of your personal data is F.H.U. BUKA Jan Gawlak-Socka, 34-500 Zakopane, ul. Walkosze 19D, NIP 7361644024. As the data administrator, we make every effort to ensure the confidentiality and security of your personal data and process it in accordance with the law.

 

II. Purposes and basis of processing

As an administrator, we will process your data:

- based on your consent (based on Article 6(1)(a) of the GDPR):

- in order to conclude a contract based on your interest in our offer (basis in Article 6(1)(b) of the GDPR);

- for proper performance and on the basis of the contract when we concluded it with you (basis in Article 6(1)(b) of the GDPR);

- to enable you to make reservations and purchase the services provided (basis in Article 6(1)(b) of the GDPR);

- for tax purposes and in connection with other legal obligations of the administrator (basis in Article 6(1)(c) of the GDPR);

- for analytical purposes (better selection of services to the needs of our clients, general optimization of our products, optimization of service processes, building knowledge about our clients, financial analysis of our company) which is the implementation of our legally justified interest in this regard (basis in Article 6(1) letter f GDPR);

- for archival (evidential) purposes, which are the implementation of our legitimate interest in securing information in the event of a legal need to prove facts (Article 6(1)(f) of the GDPR);

- in order to possibly determine, pursue or defend against claims being the implementation of our legally justified interest (basis in Article 6(1)(f) of the GDPR);

- to the extent necessary to clarify the circumstances and determine liability in connection with the use of Our services inconsistent with the provisions of law or the regulations for the provision of services (basis in Article 6(1)(f) of the GDPR);

- in order for us to offer you products and services directly (direct marketing), which is the implementation of our legally justified interest (basis in Article 6(1)(f) of the GDPR).

 

III. Data sharing

1. We do not trade in your personal data, nor do we share them with other entities, nor do we transfer them to third countries, except when:

   a) you consent to their disclosure to other entities or transfer to a third country,

   b) it is necessary for the performance of contracts between us and the data subject, or when it is necessary for the performance of contracts concluded in the interest of the data subject between us and another entity,

c) the law allows it.

2. Access to your data is available in particular to other entities if they are parties to contracts with you, participate in the provision of services provided for in contracts with you, fulfill your orders (in particular other tour operators, entities providing hotel, transport and tourist services, banking or insurance services).

 

IV. Right to object

1. You have the right to object to the processing of your data described above at any time. We will stop processing your data for these purposes unless we can demonstrate that there are valid legitimate grounds for us in relation to this data or the data will be necessary for us to establish, pursue or defend claims.

2. You have the right to object to the processing of your data for direct marketing purposes at any time. If you exercise this right, we will stop processing your data for this purpose.

 

V. Data storage period

Your personal data will be processed by us throughout the period during which the contract will be performed, as well as later, i.e. until the expiry of the limitation period for any claims arising from the contract and in connection with the implementation of the 5-year archiving obligation.

 

VI. Data recipients

The recipients of your personal data will be entities to which we are obliged to provide data under applicable law, as well as entities providing us with accounting, HR, IT, transport services, delivering courier and postal items, or our subcontractors or distributors. Your personal data may also be disclosed to our partners, i.e. companies with which we cooperate by combining products or services, including our distributors.

 

VII. Rights of data subjects:

Pursuant to the GDPR, you have: a) the right to access your data and receive a copy of it; b) the right to rectify (correct) your data; c) the right to delete data, limit data processing; d) the right to object to data processing; e) the right to transfer data; f) the right to lodge a complaint with the supervisory authority; g) when applicable, you have the right to withdraw your consent to the processing of personal data at any time without affecting the lawfulness of the processing carried out on the basis of the consent expressed before its withdrawal.

 

VIII.  Information about the requirement/voluntary nature of providing data

Providing us with your personal data is voluntary, but necessary to conclude and perform the contract.

 

IX.  Automated decision making

Your data will not be processed in an automated manner, including in the form of profiling.

Regulations

To ensure your pleasant stay, please read the rules that apply at our facility

 

 

Check-in and check-out:

The cottages are rented daily. The hotel day starts at 4 p.m. on the day of arrival and ends at 10 a.m. on the day of departure.

 

The basis for check-in is to present an ID card or passport.

 

Fee for the stay:

1. It is possible to issue an invoice for the stay, provided that we are informed about it at the time of booking and receive the invoice data. If this is not reported in advance, the invoice will not be issued.

 

2. The payment for the stay must be paid no later than on the day of arrival in cash or before arrival by transfer to the indicated bank account.

 

3. Payment of the advance payment and thus making an effective reservation means acceptance of the reservation conditions specified in these regulations and the facility regulations by the person making the reservation.

 

4. Failure to use the entire stay by a guest due to later arrival or earlier departure than specified in the reservation does not result in a reduction in the payment for the service. The Hole facility takes into account the Guest's wishes to extend the stay if possible and the availability of available dates.

 

5. An advance payment of 30% of the total amount must be paid within 48 hours of making the reservation. Failure to pay the advance payment on the agreed date will result in the cancellation of the reservation. The advance payment is refundable if the reservation is canceled at least 14 days before arrival. In case of cancellation less than 14 days before arrival, the amount paid is non-refundable.

 

Quiet time:

Please keep quiet at night from 10 p.m. to 6 a.m.

When we hand over the key to the house, you become the hosts of this place. Our behavior does not disturb the peace of neighbors. The owner of the facility may refuse to continue providing services to a person who violates this rule without refunding the amount paid for the stay.

 

In case of visitors from outside the facility, please inform us. Persons not registered at the facility may stay at the facility from 7:00 a.m. to 10:00 p.m.

 

If there are more people in the facility after 10 p.m. than reported at the time of booking, they will be asked to leave the facility or the total rental price of the facility for the booked period will be increased by 100%. The additional fee in this case is payable in cash on the same day.

 

Requests and comments:

In case of any reservations regarding the quality of services, the Guest is asked to report them to the landlord as soon as possible, which will enable an immediate response and explanation of the situation.

 

Parking:

We offer free parking at your disposal. The owners of the facility are not responsible for the car left behind or any property contained in it.

 

Fire safety:

Due to the comfort of you and our future guests as well as fire safety, smoking and the use of open flames, e.g. candles, are strictly prohibited in the facility.

 

Animals:

We like animals very much, but unfortunately due to possible allergies of other guests visiting our facility, we do not allow animals in the facility.

 

Things left behind:

Personal items left by the departing Guest will be sent back at the guest's expense to the indicated address. If the instruction is not received, these items will be destroyed after one month.
